Payment Restrictions

Ohio has special payment restrictions, see the legal mandates below.

Fingerprinting

Ohio does not require fingerprints.

Video Recording

Ohio requires facilities to record video using security cameras.

Tag and Hold

Ohio requires yards to tag-and-hold certain materials for a period of time to give law enforcement time to locate possibly stolen material matching that description.

License Scanning

Ohio requires each customers drivers license, ID card, consulate ID or passport to be scanned and kept on file.

Vehicle Descriptions

Ohio requires every purchase of scrap metal to also have the customer or drivers vehicle information recorded as part of the transaction.

Taking Photographs of Materials

Ohio requires that each material/purchase have a snapshot image to be taken while the material is being weighed.

Taking Photographs of Customers Faces

Ohio requires a photograph to be taken of the customers face at the time of payout.

Notify Law Enforcement

Ohio requires law enforcement notifications when certain materials are purchased.

NMVTIS Reporting

ALL STATES, not just Ohio are required to report vehicle purchases to NMVTIS through services like Add123.com


Legal Mandates

State Requirements

In order to sell scrap metal, sellers will be required to:

         ·            Present and allow a photocopy of a driver’s license or state ID card;

         ·            Sign a statement indicating that they are the owner of or are authorized to sell the metal;

         ·            Sign a statement that they have not been convicted of metal theft. 

Buyer’s must:

  • Record license plate number including state of issuance of sellers vehicle used to transport scrap
  • Keep a photograph or video tape showing the material and the face of the seller
  • Keep a record of sellers name, address, phone number and date of sale
  • All sales tickets must have date and time of the sale, as well as the name of the clerk completing the sale.
    • Must also show the weight, type, quantity and/or volume of the material.
    • Sales tickets must show dollar amount paid to seller.
    • Sales tickets must be signed by the seller.  Seller will receive a copy of the receipt and buyer will retain a copy.

         ·            Buyer must report purchased vehicle information to NMVTIS

         ·            Tag and hold policies are in effect for a minimum of 30 days.

NOTE:  Please be aware of your local ordinances.  Many cities and counties have additional ordinances that may not be listed here.

Keep records, certifications, registrations, etc. on site for 1 year.  Video tapes need to be kept for a minimum of 60 days. 

Scrap recyclers must maintain a record of all purchases for a minimum of one year and is subject to inspection by any law enforcement at any time. There is a 30-day tag-and-hold policy when notified by law enforcement to do so.

All purchases must be made by check made payable to the seller that must be held for a period of no less than 2 days and can be mailed or picked up in person after that time.

A daily electronic report of all purchases must be submitted to local law enforcement by the following day at noon.

It is unlawful for scrap metal dealers to purchase any materials from persons known to have been convicted of scrap metal theft.  The local law enforcement shall provide a list of such convicted persons.

It is unlawful to purchase or receive metal property from a person under the age of 18 years.

No scrap metal dealer shall purchase more than one catalytic converter per day from any person with the exception of motor vehicle dealers.

Every scrap metal dealer shall post a notice in a conspicuous place on the dealer’s premises notifying persons who may wish to transact business with the dealer of the penalties applicable to any person who does any of the following: (1) Provides a false personal identification card to the dealer; (2) With purpose to defraud, provides any other false information to the dealer in connection with the dealer’s duty to maintain the records required under division (B) of this section; (3) Violates section 2913.02 of the Revised Code.

It is unlawful to purchase bulk merchandise containers (including plastic containers) that are marked with a company’s logo without written proof that the seller is entitled to see the container.  Records of all sales of bulk containers must be kept on file.

It is unlawful to purchase the following materials without proof that the seller is licensed to sell the materials on behalf of the distributor/company:

Beer kegs, utility cable or wire, grave markers or cemetery vases, guard rails, street signs, street light poles and fixtures, water meter covers, utility access covers, traffic lights or signs, or any material believed to be owned by a government entity or public utility, historical markers, grocery carts, railroad materials (spikes, rails, etc.), or wire that has been burned or smelted.

***Scrap metal/bulk merchandise container dealers are required to report transactions through an electronic transaction reporting system maintained by the Ohio Dept. of Public Safety, O.R.C. 4737.045(E).

• The Ohio Dept. of Public Safety will maintain a “Do Not Buy From” list for use by law enforcement and scrap metal/bulk merchandise container dealers. The list will be accessible to law enforcement agencies through CIMS. Agencies will be required to provide information for inclusion into the list.
